I. Protection of your data

A. General information on the processing of your data

In this Privacy Policy, BoosConsulting ("we", "our" or "the Company") outlines its practices regarding the information collected from users who access our website at www.BoosConsulting.de ("Website") or who otherwise provide us with personal information (collectively, "Users" or "Data Subject").

The English version of the Data Protection and Privacy Policy has been prepared with due diligence. However, in case of contradictions between the English and the German version of this Policy, the German version shall prevail.

Personal data (according to Article 4 GDPR) means “any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person”.

BoosConsulting takes the protection of your data seriously and would therefore like to inform you in a transparent, understandable and easily accessible form when we collect which data from you and how we use it.

As the current legal framework evolves, changes to the content of this privacy statement may become necessary. Therefore, kindly review this privacy statement from time to time again.

The processing of data by BoosConsulting is carried out in accordance with data protection legislations, in particular the GDPR (General Data Protection Regulation; Regulation (EU) 2016/679).

The processing of data during the use of the BoosConsulting website (www.BoosConsulting.de) is described under clause B. Data protection when using our website below.

Details on the processing of data provided to BoosConsulting in other ways can be found under clause D. Data protection during other processing operations.

Your rights with regard to the data gathered from you can be found under clause E. Your rights as a data subject.


B. Data protection when using our website

The use of our website is generally possible without providing personal data. Insofar as personal data (e.g. name, address or e-mail addresses) is collected on our pages, this is always done on a voluntary basis as far as possible. This data will not be passed on to third parties by BoosConsulting without your explicit consent.

The data gathered when you access the BoosConsulting website will only be passed on to third parties if this is required by law or in the context of legal proceedings, for example.

Please keep in mind that data transmission on the Internet (e.g. communication by e-mail) can be subject to security gaps. A complete protection of the data against access by third parties is not possible. The transmission of e-mails is done SSL-encrypted.

1. Hosting of our website, including e-mails
BoosConsulting uses a commercial provider for hosting the website and e-mail communication with customers, potential customers and other interested parties (1&1 IONOS SE, Elgendorfer Straße 57, 56410 Montabaur, Germany). BoosConsulting has concluded a contract for processing with this provider pursuant to Art. 28 GDPR.
The transmission of e-mails is done SSL-encrypted. The e-mails are filed on European servers.

With regard to data protection, the provider specifies the following for the use of the website (points 1.1 to 1.11):

1.1 Which data are collected?
We collect two types of data and information from users.

The first category includes non-identifying and non-identifiable user information provided or collected through use of the Website ("Non-Personal Information"). We do not know the identity of the user from whom non-personally identifiable information was collected. Non-personally identifiable information that may be collected includes aggregate usage data and technical data provided by your device, including certain software and hardware information (e.g., browser and operating system used on the device, language preference, access time, etc.). We use this information to improve the functionality of our website. We may also collect information about your activity on the Site (e.g., pages viewed, surfing patterns, clicks, actions, etc.).

The second category includes personal data, i.e. data that identifies an individual or can be identified by appropriate means. Such data includes:
•    Device data: We collect personal information from your device. Such information includes geolocation data, IP address, unique identifiers (e.g., MAC address and UUID), and other information resulting from your activity on the Site.

1.2 How do we get data about you?
We obtain your personal data from various sources:
•    You provide us with such data voluntarily, for example when registering on our website.
•    We receive such information when you use our website or access it in connection with one of our services.
•    We obtain such information from other providers, services and public registries (for example, data traffic analysis providers).

1.3 How is the data used? To whom is the data passed on?
We do not share user information with third parties except as described in this Privacy Policy.

We use data for the following purposes:
-    To place advertisements when using our website (see "Advertising" for more information)
-    To market our websites and products (more information under "Marketing")
-    For statistical and analytical purposes, which serve to improve the website

In addition to the various uses listed above, we may also share personal information with our subsidiaries, affiliates and subcontractors.

In addition to the purposes set forth in this Privacy Policy, we may share personal information with our trusted third party providers located in various jurisdictions around the world for the following reasons:
  • Hosting and operating our website
  • Provide our services, including the personalized display of our Web site
  • Storing and processing such data on our behalf
  • Placement of advertisements and the possibility to evaluate the success of our advertising campaigns, retargeting of users

We may also disclose data when we believe in good faith that this is helpful or appropriate to order: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our policies (including our Agreement) and investigate any potential violations thereof; (iii) investigate, detect, prevent or take action against any illegal activity or other misconduct, suspected fraud or security problem; (iv) assert or enforce our own legal rights; or defend us against the claims of others; (v) protect the rights, property or safety of our users, your safety or the safety of others; or (vi) cooperate with law enforcement authorities and/or protect intellectual property or other legal claims.

1.4 Cookies
We and our partners use cookies to provide such services. This also applies if you visit our website or access our services.

A "cookie" is a small piece of data that is associated with your device when you visit a web page from that web page. Cookies are useful and can be used for various purposes. These include, for example, facilitating navigation between different pages, automatically activating certain functions, saving your settings and optimising access to our services. The use of cookies also enables us to provide you with relevant advertising tailored to your interests and to collect statistical information about your use of our services.

This website uses the following types of cookies:
a. "Session cookies" that provide for normal system usage. Session cookies are stored for a limited time during a session and are deleted from your device when you close your browser.
b. "Permanent cookies", which are only read from the Web page and are not deleted when you close your browser window, but stored on your computer for a period of time. This type of cookie enables us to identify you on your next visit and, for example, to save your settings.
c. "Third-party cookies" set by other online services that have their own content on the page you visit. These may be, for example, external web analytics companies that collect and analyze access to our website.

Cookies do not contain any personally identifiable information that identifies you, but the personally identifiable information we store may be linked by us to the information contained in the cookies. You can remove cookies from your device settings. Follow the instructions below to do so. Please note that disabling cookies may limit certain features of our website.

The tool we use is based on Snowplow Analytics technology. The information we collect about the use of our website includes, for example, how often users visit the website or which areas are visited. The tool we use does not collect personally identifiable information and is used by our web hosting provider and service provider solely to improve our own offering.

1.5 How do we protect your data?
We implement the security measures on the website with great care and protect your data. We use industry practices and guidelines to ensure the protection of the information we collect and store and to prevent the unauthorised use of such information. We also require third parties to comply with similar security requirements in accordance with this Privacy Policy. Although we take reasonable steps to protect information, we cannot be held responsible for any actions taken by those who have gained unauthorized access to or misuse of our website, and we make no express or implied warranty that we can prevent such access.

1.6 Transmission of data outside the European Economic Area
Note that some recipients may not be based in the European Economic Area. If this is the case, we will only transfer your data to countries with an adequate level of data protection approved by the European Commission or ensure an adequate level of data protection through a legal agreement.

1.7 Advertising
When you access our website, we may serve ads using third-party ad technology. This technology uses your service usage information to serve ads (for example, by placing third-party cookies in your web browser).

Opt-out option of personalized advertising:
You can opt out of numerous third-party ad networks, including those operated by members of the Network Advertising Initiative ("NAI") and the Digital Advertising Alliance ("DAA"). 1.8 Marketing
We may use your personal information, such as your name, e-mail address, telephone number, etc., ourselves or forward it to an outside subcontractor to provide you with promotional materials about our services that may be of interest to you.  

We respect your right to privacy. Therefore, these marketing materials will always provide you with the opportunity to opt out of receiving further communications. If you unsubscribe, your e-mail address or telephone number will be removed from our marketing mailing lists.

Please note that even after unsubscribing from our marketing e-mails, we will continue to send you important information e-mails that do not include a unsubscribe option. This includes maintenance notifications or administrative notifications.

1.9 Corporate transaction
We may disclose information in the event of a corporate transaction (e.g., a sale of a significant portion of a business, a merger, consolidation, or asset sale). If any of the above occurs, the acquirer or entity will assume the rights and obligations set forth in this Privacy Policy.

1.10 Minors
The protection of children's data is particularly important in the online area. The website is not designed for children and is not aimed at children. The use of our services by minors is only permitted with the prior consent or authorization of a parent or guardian. We do not knowingly collect personal information from minors. If a parent or guardian becomes aware that his or her child has provided us with personal information without their consent, he or she may contact us.

1.11 Updates or Changes to this Privacy Policy
We reserve the right to change or review this Privacy Policy from time to time. You will find the date of the current version under "Last modified on". Your continued use of the Platform following the posting of such changes on our website constitutes your acceptance of such changes to the Privacy Policy and constitutes your acceptance of the terms of the revised Policy.

2. Google Analytics
This website uses Google Analytics, a web analytics service provided by Google Inc. (1600 Amphitheatre Parkway Mountain View, CA 94043, USA).
Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website will generally be transmitted to and stored by Google on servers in the United States.
During your visit to the website, the following data is recorded: pages called up, your behaviour on the pages (e.g. length of stay), your approximate location (country and city), your IP address (in abbreviated form so that no unambiguous allocation is possible, see below), technical information such as the type of terminal device used.
The storage of Google Analytics cookies and the use of this analysis tool are based on Art. 6 (1) lit. f GDPR, i.e. a legitimate interest of the company in the analysis of user behaviour to optimise the website.

IP Anonymization
We have activated the IP anonymization function on this website. This shortens the period of anonymization within member states of the European Union or in other signatory states to the Agreement on the European Economic Area prior to transmission to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there.
Google will use this information to evaluate your use of the website, compile reports on website activity and provide other services to the website operator relating to website activity and internet usage as part of the order data agreement which the website operators have concluded with Google Inc.

Browser add-on for deactivating Google Analytics
If you do not want your website activity to be available to Google Analytics, you can install the browser add-on to disable Google Analytics. This prevents activity data from being shared with Google Analytics via JavaScript executed on websites (gtag.js, ga.js, analytics.js, and dc.js).
Analysis of data by other website owner tools is not disabled when you use the add-on. Data may also be sent to the website or other web analytics services.

4. Google Web Fonts
We use script and font libraries such as Google Web Fonts (https://www.google.com/webfonts) for this website so that our content is displayed correctly and graphically appealing in every browser. Google Web Fonts are transferred to your browser's cache so they only need to be loaded once. If your browser does not support Google Web Fonts or denies access, content is displayed in a default font.
- When you access a script or font library, we automatically connect you to the library operator. In theory, it is possible for this operator to collect data. It is currently not known whether and for what purpose the operators of the respective libraries actually collect data.

5. Links to websites of other/third parties
The BoosConsulting website may contain links to websites of other/third providers, e.g. to partner or customer companies. BoosConsulting has no influence on whether these providers also comply with the statutory data protection provisions. Please always check the data protection declarations of the other providers.


C. Data protection for online presences in social media

BoosConsulting maintains online presences within social networks/platforms in order to communicate with interested parties, customers and other users and to inform them about our activities (Art. 6 (1) lit. f GDPR - legitimate interest).
The providers of social networks/platforms usually process user data on these occasions; for these purposes, cookies are usually stored on the computers of the users in which the user behaviour and interests of the users are contained. For example, user profiles can be created. In the user profiles, data can also be stored independently of the devices used by the users (e.g. if the users are members of the respective platforms and are logged in to them). User data may also be processed outside the European Union. US providers certified under the Privacy Shield are committed to comply with EU data protection standards.
You will find a detailed description of the processing and possible rights to object in the data protection information of the respective providers.
Since only providers have access to users' data, requests for information and the assertion of users' rights should be addressed directly to them, so that they can take appropriate measures as needed.

D. Data protection for other processing operations

In addition to the data processing described above in connection with the use of our website, BoosConsulting processes data in connection with the establishment, maintenance and execution of business relationships in the consulting and service area of BoosConsulting (e.g. to answer your enquiries, to prepare an offer, to properly fulfil your order or to prepare an invoice) and the fulfilment of pre-contractual and contractual obligations. Details on data protection and data subject rights in the context of these processing operations can be found in the following sections.

Type of data:
BoosConsulting collects and processes personal data (i.e. information relating to an identified or identifiable natural person) such as your name, the name of your company, your address(es), your telephone/fax/mobile phone number(s), your e-mail address(es), your Internet address, the name(es) of the contact person(s) or your tax number/tax identification number (Art. 4 GDPR); if necessary, data going beyond this will be stored/processed on the basis of your express consent or are the subject of an order from you.

Purpose of use of the stored data:
BoosConsulting processes the personal data because you (as the data subject) have given your consent [Art. 6 (1) a) GDPR], because the processing is necessary for the performance of a contract (to which you are a party as the data subject) or for the implementation of pre-contractual measures [Art. 6 (1) b) GDPR] because it is necessary to fulfil a legal obligation to which BoosConsulting is subject [Art. 6 (1) c) GDPR] or because the processing is necessary to safeguard the legitimate interests of BoosConsulting or a third party (unless the interests or fundamental rights and freedoms of you (as the data subject) which require the protection of personal data prevail) [Art. 6 (1) f) GDPR].

Access rights of third parties:
Third parties have no access to the data stored by BoosConsulting. BoosConsulting will not pass on your data to unauthorised third parties. The transfer of data to authorised third parties is subject to your express consent or a corresponding contract/order. Excluded from this is the passing on to third parties insofar as BoosConsulting is obliged to do so by law or by a court decision or this is necessary for legal or criminal prosecution.

Place and duration of data storage:
Your data will be stored or processed in the State of Hesse of the Federal Republic of Germany, but not in states outside the scope of application of the GDPR. The duration of the data storage depends on the legal storage obligations and usually amounts to 10 years (e.g. in tax law). After these periods have expired, the relevant data may be deleted as a matter of principle if they are no longer required for the fulfilment of a contract or the enforcement of legal claims. If data is not subject to any storage obligations or periods, it will be deleted as soon as it is no longer required for the purpose for which it was collected.


E. Your rights as an affected party / data subject

BoosConsulting treats your data with great care. You have the right to information about the data BoosConsulting has stored about you (Art. 15 GDPR). In addition, you have the right to correction (Art.16 GDPR), deletion (Art.17 GDPR), restriction of processing (Art.18 GDPR), revocation of consent (Art. 7 (3)) or right to object to processing (Art.21 GDPR). Please contact BoosConsulting for this purpose by e-mail or by post. In order to facilitate the compilation of the necessary data, you should specify your request in your request for information. Your right to deletion, restriction of processing and objection to processing may be restricted by the fact that BoosConsulting still requires your data to fulfil statutory tasks or that a legal provision obliges it to be processed. You also have the right to data transfer (Art. 20 GDPR). II. Protection of our data

General information on the processing of our data

The use of published postal addresses, telephone or fax numbers and e-mail addresses for marketing purposes is prohibited; offenders sending unwanted spam messages will be punished. BoosConsulting reserves the right to take legal action against unsolicited mailing or e-mailing of spam and other similar advertising materials.
